1. Agreement to Terms
By downloading, installing, or using the COOLPHABETS mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. If you are accepting on behalf of a minor, you represent that you are the parent or legal guardian of that minor.
These Terms constitute a legally binding agreement between you and Coolphabets Applications LLC ("Company," "we," "us," or "our").
2. Description of Service
COOLPHABETS is a mobile application that teaches Indian language scripts — including Telugu, Tamil, Hindi, Marathi, Kannada, Malayalam, Bengali, Gujarati, Odia, and Punjabi — through interactive lessons, games, handwriting practice, and audio content. Features include:
On-device AI handwriting feedback
Native and parent-recorded audio
Solo and family games
Multiple child profiles
Offline functionality
The App is available on iOS (Apple App Store) and Android (Google Play Store).
3. Eligibility and Children's Use (COPPA)
The App is designed for use by children under parental supervision. We comply with the Children's Online Privacy Protection Act ("COPPA"). The following rules apply:
The App is intended to be used by children under the age of 13 only under parental consent and supervision.
We do not knowingly collect personal information from children under 13 without verifiable parental consent.
All AI processing runs on-device. Usage data and learning progress data transmitted to our servers is used for sharing within the family.
By registering an account, parents or guardians confirm they are at least 18 years old and consent to these Terms on behalf of their child(ren).
If you believe a child has provided personal information without parental consent, please contact us at [email protected] and we will promptly delete such information.
4. Account Registration
To access premium features, you must create an account. You agree to:
Provide accurate and current registration information.
Maintain the security of your account credentials.
Notify us promptly of any unauthorized access to your account.
You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Subscription and Payments
5.1 Plans
COOLPHABETS offers the following paid plans:
Solo — $79/year: All letters, all languages, words and sentences, 20+ games, parent voice recording, 1 child profile.
Super Family — $99/year: Everything in Solo, plus up to 6 child profiles, 10+ family games, Family Sharing, and family dashboard.
The prices may change depending on where you are making the purchase (In App purchase vs Outside App purchase on web or offline purchase). Final prices including any discounts are reflected directly within the apps or website.
5.2 Free Trial
All plans include a 7-day free trial. No charge is made during the trial period. At the end of the trial, the applicable subscription fee will be billed automatically unless you cancel before the trial expires.
5.3 Billing
Subscriptions are billed annually and renew automatically unless cancelled. Payments are processed through the App Store (Apple) or Google Play or via a payment gateway (like Stripe, Dodo Payments, etc). The Company does not directly store payment card information.
5.4 Cancellation and Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for unused subscription periods except where required by applicable law.
6. License to Use the App
Subject to your compliance with these Terms and payment of applicable fees, the Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for personal, non-commercial educational purposes.
You may not: (a) copy, modify, or distribute the App; (b) reverse engineer or attempt to extract source code; (c) rent, lease, or sublicense the App; (d) use the App for any commercial purpose; or (e) remove any proprietary notices from the App.
7. Intellectual Property
All content in the App — including text, graphics, audio, animations, software, and curriculum — is the exclusive property of Coolphabets Applications LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to the Company's intellectual property except the limited license described in Section 6.
8. User-Generated Content
The App allows parents to record their own voice for playback within the App ("User Content"). You retain ownership of any User Content you submit. By submitting User Content, you grant the Company a limited, non-exclusive license to store and process that content solely to provide the App's features.
User Content may be transmitted to our servers in order to sync it with your other family members. You are responsible for ensuring any User Content you provide is lawful and appropriate.
9. Privacy
Your privacy is important to us. Our Privacy Policy, available at coolphabets.com/privacy-policy, describes how we collect, use, and protect information. The Privacy Policy is incorporated into these Terms by reference. Key points:
The App functions primarily offline. Any usage data collected remains strictly within the family.
No third-party advertising or tracking SDKs are embedded in the App.
Account information (e.g., parent email) is used solely to manage your subscription.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not guarantee specific learning outcomes. Educational results depend on individual effort, parental involvement, and frequency of use.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COOLPHABETS APPLICATIONS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Coolphabets Applications LLC and its affiliates, officers, directors, and employees from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) any User Content you submit.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the App shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA) in Boston, Massachusetts, except that either party may seek injunctive relief in a court of competent jurisdiction.
YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website and updating the Effective Date above. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
15. Termination
We may suspend or terminate your access to the App immediately, without prior notice, if you violate these Terms or for any other reason at our sole discretion. Upon termination, your license to use the App ends immediately. Sections 7, 10, 11, 12, and 13 survive termination.
